Making AYP For One year
The following memo went out from the office of Jeremy
Hughes, Chief Academic Officer, Michigan Department of

Preliminary calculations indicate that a number of schools that
wereimplementing some phase of NCLB consequences, because of not
making adequate yearly progress (AYP) in the past, have just
made AYP on the 2004 EducationYES! report cards.
This is a good time to remind everyone of the following:
* If a school makes AYP for one year, it is "frozen" at its
current NCLB consequence step and does not advance to the next
step. Further consequences are delayed. The school MUST,
however, continue to implement the consequence at its frozen
step.
* In order to be free of consequences and "get off the no-AYP
list," a school needs to make AYP for two years in a row.
Example # 1 - School is in Phase 1 (had not made AYP for two
years) and last year (2003-04) was required to offer choice and
transportation to parents. School just made AYP on 2004 report
card. School must continue to offer choice and transportation
for 2004-05 school year but is not required to offer
supplemental educational services, which would be required in
Phase 2.
Example # 2 - School is in Phase 4 (had not made AYP for five
years) and last year (2003-04) was required to develop a plan
for restructuring. School just made AYP on 2004 report card. In
2004-05 school year, school must continue to plan for
restructuring but is not required to implement the restructuring
plan, which would be required in Phase 5.
Note: One of the positive results of NCLB has been the intensive
and productive school improvement planning on the part of many
schools. Schools and/or districts that have momentum going on a
school improvement plan should be supported if they wish to
proceed with their plan, even given the one year "freeze" they
may have just earned.
Schools That Did Not Make AYP
The following memo was sent from the office of Jeremy
Hughes, Chief Academic Officer, Michigan Department of
Education, on June 18, 2004.
Schools that are in Phase 3 (Corrective Action) and Phase 4
(Development of Restructuring Plan) are reminded that NCLB -
Section 1116(b)(8)(C) - requires that a school district: *
Provide prompt notice to parents and teachers of the need for
corrective action or restructuring planning, and * Provide
parents and teachers an "adequate opportunity" to: 1. Comment
before taking any action, and 2. Participate in developing any
plan. This is a reminder to schools that did not make adequate
yearly progress (AYP) on the 2004 preliminary school
EducationYES! report cards that were just issued.
* If this is the first year that the school did not make AYP,
none of the NCLB consequences are required. The consequences
apply only after a school has failed to make AYP for two
consecutive years. The new preliminary report card now
indicates if a school is in a certain phase of implementing NCLB
consequences. This is depicted in the column titled "School
Phase 2003-2004." Phases are as follows:
Phase 0 - No consequences apply.
Phase 1 - School has not made AYP for two years = choice and
transportation offered. Phase 2 - No AYP for three years =
choice (C), transportation (T), supplemental services (SS)
offered.
Phase 3 - No AYP for four years = CTSS and implementation of
Corrective Action plan. Phase 4 - No AYP for five years = CTSS
and development of plan to restructure school.
Phase 5 - No AYP for six years = CTSS and implementation of
restructuring plan.
* If a school is in Phase 1, 2, 3, 4, or 5:
1. The NCLB consequences are to be implemented IMMEDIATELY (if
the school is not filing an appeal) and not delayed until the
public release of the report card in August. Immediate action
will permit eligible students to receive services over the
summer and families to make enrollment decisions for the fall.
2. Letters must be sent to parents informing them of the choice,
transportation, and supplemental services options (SS not
required of Phase 1 schools). Letters must also indicate whether
a school is in Corrective Action, or needing to develop a
restructuring plan, or needing to implement a restructuring
plan.
3. If the school is filing an appeal, the implementation of the
consequences may be delayed until the appeal is resolved.
Parent and Teacher Participation
Schools that are in Phase 3 (Corrective Action) and Phase 4
(Development of Restructuring Plan) are reminded that NCLB -
