A bill to amend 1997 PA 16, entitled

"The playground equipment safety act,"

by amending the title and section 6 (MCL 408.686).

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 TITLE

2 An act to regulate the manufacturing, and assembling, and

3 maintenance of public playground equipment; and to provide

4 penalties.

5 Sec. 6. (1) Except as otherwise provided in subsection (2),

6 the local unit of government, school district, or governmental

7 entity that owns and operates the public playground equipment

8 shall be is responsible for the maintenance, repair, and upkeep

9 of the public playground equipment according to the standards

10 identified by this act and for posting a notice on all playground

11 equipment that contains chromated copper arsenate. The notice

1 shall state that the playground equipment contains chromated

2 copper arsenate and that hand washing after contact is

3 recommended and may include information concerning the health

4 risks associated with that substance.

5 (2) For the maintenance, repair, and upkeep of public

6 playground equipment that existed before the effective date of

7 this act, the standards required by section 4 shall apply only to

8 the extent that such application applying those standards is

9 possible without requiring substantial alteration, removal, or

10 replacement of the existing equipment.
